New member needing assistance if possible.

Hi,

I am Blackie Swart and own a 2003 Nissan Patrol. This vehicle has now been at a supplier for a year and a half to get an Infinity VK V8 conversion done. I have been through a lot of steps in trying to get the vehicle back. The work is about 90% done but the guy does not want to finish the vehicle or farm out the remaining work and is just playing for time (he says he has lean on the vehicle.) I went to the ombudsman 6 months ago. No help whatsoever. I went to an attorney that said that he cannot help as long as the case is with the ombudsman. I even went to the police that said that I need to follow the legal route as they cannot get involved out of fear for being sued. I have asked numerous times for an invoice (I have paid 66k so far) but get nothing out of this guy. I also understand that I am not the only client that is going through this hell and there are various vehicles that has been there for months (one now for 2 years I believe). Abandonment scam??? I would highly and truly appreciate any advice regarding a reference to a good attorney (in the Cape Town area.) as I am pursuing a court order now to get my car released as I believe this is the only way forward now. A possible class action may also be a posibility. If I succeed in getting the vehicle out of there, I have a reputable person that will finish it.
This has been a wonderful car but once I get this rersolved I will probably sell. What an emotional traumatic experience that I do not wish upon anyone. I truly wish that in South Africa we can get some kind of governing body that can avoid this kind of thing from happening.

Thanks to all for the advice. I have lodged a complaint with the consumer council just now. A friend spoke to a Colonel in the SAPS and the advice was, as you correctly stated theft, but apparantly a civil case can also be made for loss of use, licensing and depreciation. I was not aware of fraud as a possible charge (thanks.) We will perservere. It is still a sad story.

As oom Mac said making a case at SAPS would be a route to go. Me personally would just get a tow truck and go hitch my vehicle as owner. There is no way he can stop me for collecting my vehicle. Once the vehicle is out i would follow the fraud route and any other charge that may be applicable.
